Acceptance of terms

These Terms of Use ("Terms") govern your access to and use of the websites, forms, and services offered by Survival 401k, LLC ("Survival 401k," "we," "us," or "our"). By using the site or submitting information through it, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the site.

Not a lender; referral service

Survival 401k is not a lender, mortgage broker, or financial advisor, and does not make credit decisions or originate loans. We operate a lead-generation and referral service that connects prospective borrowers with third-party lenders and service providers in our network. All loans, terms, rates, fees, underwriting decisions, and closings are set and controlled by the lender. Nothing on this site is a commitment to lend or an offer of credit.

Referral compensation disclosure

Survival 401k receives compensation from lenders and other partners in our network when borrowers we refer are matched, funded, or enroll in a product or service. This compensation may influence which lenders or products we present. It does not change the rate, fees, or terms offered to you by any lender. You are never required to use a lender we refer.

No professional advice

The content on this site is provided for general informational purposes only and is not legal, tax, accounting, investment, or financial advice. You should consult your own qualified professionals before making decisions about loans, retirement accounts, or business structures.

Eligibility and accurate information

You must be at least 18 years old and legally able to enter into contracts to use this site or submit information through it. You agree to provide accurate, current, and complete information and to keep it up to date. Submitting false or misleading information is grounds for immediate termination of access.

Consent to be contacted (TCPA)

By submitting your information, you expressly consent to be contacted by Survival 401k, LLC and by lenders and partners in our referral network at the phone number(s) and email address you provide, including by autodialer, prerecorded or artificial voice messages, and SMS or MMS text messages, for marketing and servicing purposes. Your consent is not a condition of purchasing any goods or services. Message and data rates may apply. You may opt out at any time as described in our Privacy Policy.

Acceptable use

• Do not use the site for any unlawful or fraudulent purpose
• Do not submit information about anyone other than yourself without authorization
• Do not interfere with, disrupt, probe, or attempt to gain unauthorized access to the site or related systems
• Do not scrape, harvest, or use automated means to access the site without our written permission
• Do not upload viruses, malware, or harmful code

Intellectual property

The site, including text, graphics, logos, and other content, is owned by Survival 401k or its licensors and is protected by intellectual-property laws. Limitation of liability

To the fullest extent permitted by law, Survival 401k, LLC and its owners, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of the site or any referral. Our total liability for any claim relating to the site or our services will not exceed one hundred dollars (USD 100).

Indemnification

You agree to indemnify and hold harmless Survival 401k, LLC and its owners, officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the site, your submissions, or your violation of these Terms or any law.

Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the site will be brought exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction and venue there.

We may update these Terms from time to time. The "Last updated" date shows when the Terms were last revised. Your continued use of the site after changes take effect constitutes acceptance of the revised Terms.
